1. Introduction
The entity you are contracting with is HALDI & HEALTH (herein referred to as "the company") registered under the Companies Act, 1956, and presently governed by the Companies Act, 2013. The transactions in this website are subject to the laws enforceable in India. By subscribing to or using any of the services of the website you agree that you have read, understood, accepted and are bound by the terms and conditions contained herein. This website is for online "offer and acceptance" of the jewellery items posted and advertised on the website. The terms and conditions may be changed, altered and/or revised at the discretion of the company without prior notice.
2. Membership
Membership corresponding to transaction rights is available only to persons who can form legally binding contracts under Indian Contract Act, 1872.
3. Account
While transacting through the Website you are responsible for maintaining the confidentiality of your User ID and Password, as well as access to your cell phone and to your computer, computer system and computer network, and further you are responsible for all activities that occur under your "User ID" and "Password", e-mail address and cell phone number as the case may be. As a User you inter alia agree to:

We wish to keep you updated on all our offerings and offers and accomplish the same by sending you periodical mails at your registered e-mail. You may opt-out of the same, but it is not recommended.
5. Sale of goods
· All transactions shall be subject to the provisions of the Supply of Goods Act, 1930 read with its subsequent amendments.
· The transaction is deemed to be complete once the "Tax Invoice" for the goods ordered is raised, and the company shall deliver through a third party courier or its own delivery personnel.
· All sales/(supplies) are subject to taxes under Central Good and Service Tax Act, 2017 and rules thereunder with West Bengal Good and Service Tax Act, 2017 and rules made thereunder in case of customers residing in West Bengal or Integrated Good and Service Tax Act, 2017 and rules thereunder if the customers are residing outside West Bengal.
· The offer for sale is restricted to the items displayed in the brochures on the Website. The company reserves its right to remove, delete, add, alter, modify or discontinue any item or the entire brochure without any prior notice.
· An order will be deemed to have been accepted only after the full consideration is received by the company and credited to the bank account of the company.
· The products offered are all handcrafted and are “made to order”. We do not keep ready stock of . Due to the handcrafted nature of the product, minor and subtle variations of the delivered product may occur in comparison to the displayed product, in weight and form and colour up to a maximum permissible value of +-10%. Our offer is subject to such minor variations
6. Payments
· The payment against a purchase shall be due in advance.
· Customer may only make payments through the payment gateway of this Website..
· All payments made against the purchases on the Website shall only be in Indian Rupees.
· Payments shall be deemed to have been received only when such monies are credited to the company's bank account and are freely available to the company.
7. Delivery
· The ordered goods shall be deemed to be in transit for delivery once despatched through a third party courier and shall be deemed to be delivered once handed over to the customer or to the person authorized as instructed.
· Goods can only be delivered to the customer or to his/her authorized person. In order to authorize a person to take delivery of goods the customer is requested to send us an email to info@haldiandhealth.com with instructions.
· The recipient of the goods is obliged to produce valid identity proof and address proof or such other documents to verify and establish his bona fide at the time of delivery to ensure safe delivery of the goods purchased.
· Valid identity proof shall include:
o Voter’s ID Card [EPIC]
o Aadhar card
o Passport
o Driving License
o Any identity card issued by the Central Government or State Government.
o PAN Card shall NOT be considered as a valid Identity proof.
· The company shall issue an invoice against every transaction and the third party courier shall hand over the original copy of "Tax Invoice" to the customer at the time of delivery of the goods ordered.
· The customers are requested to inspect the purchased item and accompanying papers promptly and immediately. Attention is drawn to the "Return Policy" in this connection.
8. Insurance
· To safeguard the interest of the customer for the goods ordered, the company shall arrange for transit insurance free of cost valid till its delivery.
· Minor damages or deformations or deteriorations in the course of the delivery are not covered by transit insurance.
· The customer on request shall provide all information and documents, as may be required, to assist the company to lodge and substantiate claims against the insurer in the event of a loss.
9. Warranty
The goods shall be considered to have a defect in quality if they have an inherent material or manufacturing defect. Minor deviations from the image shown on the Website shall not qualify as a defect.
10. Disclaimer
· The photographs and impressions displayed on the website are for reference only and are not to scale. The size, colour, finish, luster and other visual parameters of the actual product may differ to an extent from the photographs and impressions displayed on the website. Moreover, the items being mostly hand-crafted, actual products delivered may differ to an extent.
· The customers are advised to contact the company at our Customer Helpline: +91 8016580620 during business hours [Timings: Tuesday to Saturday 10:00 am to 5:00 pm and Monday 1:00 pm to 5:00 pm] for any query or clarification.
· The company or the website shall not be responsible for any unauthorized use of credit or debit cards for making any transaction and shall have no liability either to the true holder of any credit or debit card or to the concerned bank for any unauthorized/fraudulent use of payment instruments.
· The company declares that it has no obligations beyond the terms and conditions and representations mentioned herein.
11. Governing Law
Any and all questions of enforceability and interpretation which may arise under this Agreement shall be determined and governed by and in accordance with the laws of India.
12. Alterations and Modifications
The company reserves the right to change, modify, alter and/or substitute any or all the terms and conditions mentioned herein at any time and from time to time at its sole and absolute discretion and accord, without giving any prior notice and/or intimation to any person, including its customers.
12. Acceptance
By registering at this Website and transacting thereafter the customer agrees, accepts and acknowledges to abide by the terms and conditions mentioned above.
Shipping Policy
Shipping of the order from www.haldiandhealth.com is very safe, secure, and hassle-free.
We provide delivery/shipping on all items within India. All item listed on the website is “made to order” & it may take up to 5 Days
We urge all customers to inspect the package for any damage or tamper before receiving or signing for receipt.
For our Indian customers, after your item has been packaged, it will be shipped and delivered via either of the following carrier.
· Indian Post
· Blue Dart
Currently we do not have services to ship internationally.
Customers have to enter the correct details of Consignee / Recipient Name (as it is stated in their photo identification that is approved by the Government) with complete Address, nearby landmark, pin code, and contact number for hassle-free delivery.
As the product reaches the destination, at the time of delivery, the recipient will have to provide any of the mentioned below identity proofs to collect the product :-
· Adhar
· Passport
· PAN
· Driving License
· Voters ID
We make sure that delivery is made with the help of the courier agent after checking the identity proof of the recipient and the courier agent confirms the same. To make sure that the delivery is safe and secured, the courier agent will note down details of the recipient's identity proof. During this process, the receiver is expected to cooperate with the agent by providing original copies of identity proof.

Cancellation Policy (Online Purchase Only)-:
An order can be cancelled within 3 days of placing the same through our website (www.haldiandhealth.com) or by sending an e-mail to " info@haldiandhealth.com ".
Refund of monies paid against a cancelled order shall be made by cheque. Electronic transfers are not available currently.
Any request for cancellation beyond the stipulated 3 days shall be subject to the replacement policy.
Cancellations are exempt from the verification policy.
Replacement Policy (Online Purchase Only)-:
The products being offered are handcrafted may vary slightly in physical appearance and upto +-10% in weight and colour. Requests for returns or replacement will not be entertained for such variations.
Replacements shall only be entertained if the actual product along with the invoice for the same is returned Haldi & Healh, Sakyong GP2, Pedong 734311. [ cell no +91 8016580620 ]
A replacement shall only be processed upon successful verification. Please read the Verification Policy for further information.
A replacement shall be allowed free of cost when the company acknowledges that the product received by the customer is substantially different from the ordered product.
If the company is satisfied that any of the products sold have an inherent manufacturing defect, despite every precaution and rigorous quality control being undertaken, it shall be replaced free of cost.
Any complaint or replacement request shall be considered only if made within 48 (forty-eight) hours from delivery by communication through the registered e-mail address, mentioning Customer name , phone number, date and time of delivery and clearly and accurately describing the nature of the complaint. No complaints or requests for any replacement will be accepted or entertained after 48 (forty-eight) hours from the delivery of the goods ordered.
VERIFICATION POLICY (Online Purchase Only)-:
If a product leaves our possession and is subsequently returned either for replacement and/or exchange it is subject to a verification process by our team. The verification team inter-alia ascertains the genuineness of product returned and whether the same product has been returned.
The verification process usually takes 7 days to complete.
Refund Policy (Online Purchase Only)-:
In the event, a customer wishes to cancel an order in terms of our cancellation policy or opts to not replace a returned item as stated above, a refund may be initiated.
A refund can only be initiated if the goods are returned to the company at “ Haldi & Healh, Sakyong GP2, Pedong 734311”. [ cell no +91 8016580620 ]
and verified as stated above.
A refund usually takes 10 to 15 days to process.
All refunds shall be done by Account Payee Cheques in the name of the customer and none other.
Dispute Resolution Policy
In the event of a disagreement between the buyer and HALDI & HEALTH [hereinafter referred to as the Company] the same shall be resolved in the following manner:
1. Dispute :
Subject to terms and conditions and the applicable laws including the principle of Caveat Emptor, a dispute shall be construed to be a disagreement between the buyer and the company of either the quantity and/or the quality of the product.
2. Claim :
In case of a dispute the buyer shall initiate a claim within 48 hours of receipt of the product, by email at “info@haldiandhealth.com” .Any claims made beyond the 48 hour limitation shall not be entertained.
3. Pre-requisites to a claim :
A valid claim shall inter-alia satisfy the following pre-requisite criteria
· A claim shall inter-alia contain the Customer Name and phone number and the time of delivery.
· A claim shall further include a precise and accurate description of the claim.
· A claim shall contain an “un-boxing video”, clearly showing the tamper proof packaging from all sides, the action of opening it and the product in sequence, WITHOUT any stoppages and/or edits.
· A claim may contain any further evidences and/or documents that the buyer may rely upon.
4. Resolution Process :
The company shall upon receipt of a valid claim constitute an Internal Investigation Team, consisting of a technical member and an independent member. The Internal Investigation Team shall consider the claim in light of the evidences submitted by the buyer and the company, and shall submit an Internal Investigation Report within 10 workings days of receipt of the claim.
5. Review :
In case a buyer is not satisfied with the findings and/or conclusions of the Internal Investigation Team, the buyer may opt for a review of the same by drawing attention to the specific points of disagreement that in the considered opinion of the buyer the Internal Investigation Team may have overlooked and/or failed to consider. A review may be preferred within 48 hours of receipt of the Internal Investigation Report.
6. Applicable Laws :
The laws and principles applicable in resolving a dispute shall be the laws enforceable in India, along with the principles of Natural Justice.
